Terms of Service

1. Agreement to Terms

By accessing or using Eto (eto.tools), operated by ETO, a sole trader business (toiminimi) registered in Finland, European Union, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ETO regarding the Service. By using the Service, you acknowledge that you have read and understood both documents.

2. Who Can Use Eto

To use the Service, you must:

Be at least 18 years of age (or the age of legal majority in your jurisdiction, if higher)
Be, or intend to become, an Etsy seller with an active Etsy account
Have the legal capacity to enter into binding agreements
Provide accurate, current, and complete information during registration
Maintain and promptly update your information to keep it accurate
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account

You agree to notify us immediately of any unauthorized use of your account. One Eto account per person or business entity. We may suspend accounts registered with false information.

3. What Eto Does

Eto is a SaaS web application — an AI-powered seller operations platform for Etsy sellers. It is not a marketplace. Eto does not buy or sell goods. It connects to your existing Etsy account and provides tools to manage your business. Current features include:

Etsy Store Connection: Connect your Etsy shop via OAuth 2.0 to manage it from the Eto dashboard
Listing Management: View, create, edit, and publish product listings to your Etsy shop
Inventory Sync: Monitor and update stock levels across your connected stores
Order Management: View and track orders imported from your Etsy shop
Analytics Dashboard: Revenue figures, sales trends, listing performance, and financial reporting
Product Research: Etsy marketplace search, bulk research, and keyword analysis tools
AI Studio: AI-powered text generation (titles, descriptions, tags) and image generation for listings
Product Hunt Agent: AI research assistant that identifies product opportunities and generates draft listings
Keyword Research: Search volume, competition analysis, and related keyword discovery
Virtual Assistant Management: Create and manage VA accounts with granular permissions
Automation Workflows: Automated actions based on triggers you configure
Supplier Share Links: Time-limited links to share order details with your suppliers

Features vary by subscription tier. Current pricing and feature availability are displayed on our website. We reserve the right to modify, suspend, or discontinue any feature at any time, with or without notice.

4. Connecting Your Etsy Store

4.1 OAuth Authorization

By connecting your Etsy shop, you grant Eto permission to access your Etsy account within the scopes you approve during the OAuth 2.0 authorization flow. The specific permissions we request are:

shops_r / shops_w: Read and update your shop information (name, policies, settings)
listings_r / listings_w / listings_d: Read, create, update, and delete your product listings
transactions_r / transactions_w: Read and update your order and transaction data
email_r: Read the email address associated with your Etsy account
address_r: Read your shop address information
billing_r: Read your billing information
profile_r: Read your Etsy user profile

4.2 Your Responsibilities

You warrant that you are the legitimate owner (or authorized representative) of the Etsy shop you connect
Your use of Eto must comply with Etsy's Terms of Use, Seller Policy, and API Terms of Use at all times
Eto is not responsible for actions taken by Etsy against your account, including suspension, listing removal, or policy enforcement

4.3 Token Storage and Revocation

Your OAuth tokens are stored encrypted at rest. You can revoke Eto's access at any time by disconnecting your shop in Eto's settings or by revoking the app's permissions in your Etsy account settings. Upon disconnection, your OAuth tokens are deleted immediately.

5. Listing Management and Publishing

Eto allows you to create, edit, and publish listings to your Etsy shop via the Etsy API
You are solely responsible for all listing content you create or approve, including accuracy, pricing, compliance with Etsy's listing policies, intellectual property rights, product safety regulations, and all applicable laws
Eto does not review or pre-approve listing content before it is published to Etsy
Eto is not responsible for Etsy removing, flagging, or penalizing listings published through our platform
Changes you make in Eto are written to Etsy using your authorized OAuth token — every action taken through Eto on your Etsy shop is your action

6. AI-Powered Features

6.1 AI Studio

Eto provides AI-powered tools to generate listing titles, descriptions, tags, and product images. These features are powered by the Google Gemini API (provided by Google LLC). When you use AI Studio:

Your text prompts, product details, and context are sent to Google's Gemini API for processing
Generated content is returned to Eto and stored in your account
Your personal account data and buyer order data are not sent to the AI provider
Google does not use API inputs to train its models under its commercial API terms

6.2 Product Hunt Agent

The Product Hunt Agent is an AI research assistant that helps you identify product opportunities in the Etsy marketplace. It is powered by the Google Gemini API and the Anthropic Claude API. The Agent:

Searches publicly available Etsy marketplace data to identify product opportunities
Analyzes keyword search volume, competition, and market trends using keyword insight APIs
May use Google Search (via Gemini's search grounding) for additional market context
Can create draft listings for your review — it cannot automatically publish listings to your Etsy shop
Stores research findings, conversation history, and saved opportunities in your session memory

Anthropic does not use API inputs to train its models under its commercial API terms.

6.3 AI Output Responsibility

You are solely responsible for reviewing, editing, and approving any AI-generated content before using it. Eto makes no guarantee that AI-generated content is:

Accurate, truthful, or free from errors
Original or free from potential intellectual property claims
Compliant with Etsy's policies or any marketplace's rules
Suitable for any particular purpose

AI-generated images may contain artifacts, inaccuracies, or elements that resemble existing copyrighted works. You use AI-generated content entirely at your own risk.

6.4 Ownership of AI-Generated Content

Once AI-generated content is produced and saved to your account, you own it. Eto does not claim ownership of content generated for you. However, your use of AI-generated content is subject to the terms of service of the underlying AI providers (Google Gemini and Anthropic Claude).

6.5 AI Image Disclosure to Etsy

If you use AI-generated images in your Etsy listings, you are solely responsible for accurately disclosing to Etsy that the images are AI-generated, in accordance with Etsy's policies on AI-generated content. Eto does not automatically label, tag, or disclose AI-generated content to Etsy on your behalf. Failure to disclose AI-generated content as required by Etsy's policies may result in Etsy taking action against your account, for which Eto bears no responsibility.

7. Order Management and Buyer Data

Eto imports your Etsy order data and displays it in a unified order management dashboard
Order data includes buyer personal information (name, email, phone, shipping address) received from the Etsy API under your OAuth authorization
Eto does not process payments — all transactions occur on Etsy's platform
Eto does not contact buyers directly — it only displays the order data to you

7.1 Your Obligations as Data Controller

Under GDPR, you (the seller) are the data controller for buyer personal data. You must:

Use buyer data obtained via Eto only for the purpose of fulfilling orders, in accordance with Etsy's buyer data policies and applicable privacy laws
Not use buyer data for unsolicited marketing or any purpose unrelated to order fulfillment unless the buyer has given separate consent
Take responsibility for any buyer data you share via supplier share links — ensure your suppliers handle this data appropriately

8. Subscription and Billing

8.1 Subscription Plans

Eto offers multiple subscription tiers with varying features and usage limits. Current pricing and feature details are displayed on our website. We may offer a free tier with limited functionality and a free trial period for new users.

8.2 Payment Terms

Subscription billing is handled by Stripe. Payment is due in advance for each billing period
Billing periods may include weekly (7 days), monthly (30 days), or annual (365 days) options, depending on the plan
If a payment fails, your subscription will not renew and your access will revert to the free tier at the end of your current billing period

8.3 Refund Policy

Refunds are available within 7 days of purchase. If you are unsatisfied with the Service, you may request a full refund within 7 days of your subscription purchase or renewal date. To request a refund, contact us through our contact page.

After 7 days, all subscription fees are non-refundable. No partial refunds, pro-rated refunds, or credits will be issued after the 7-day refund window has passed, including for early cancellation or failure to use the Service during a billing period.

Consumer Protection Notice: This refund policy is subject to, and does not override, any mandatory consumer protection or refund rights provided by applicable law in your jurisdiction, including but not limited to EU consumer protection regulations and Finnish consumer law (Kuluttajansuojalaki). Where local law grants you a statutory right to a refund beyond the 7-day window, ETO will comply with such legal requirements.

8.4 Cancellation

You may cancel your subscription at any time, with no cancellation fees or penalties. Upon cancellation, you will retain access to paid features until the end of your current billing period, after which your access will revert to the free tier (if available) or be suspended.

8.5 Price Changes

We reserve the right to change our pricing with 30 days' notice to registered users. Price changes will apply to the next billing period following the notice. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

9. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any laws
Violate any third-party rights, including intellectual property rights
Violate the terms of service of Etsy or any other third-party platform that you access through or in connection with the Service. Eto requires all users to fully comply with Etsy's Terms of Use, Etsy's Seller Policy, and all other applicable Etsy policies at all times
Use the Service to publish listings for counterfeit, illegal, prohibited, or dangerous items
Use AI features to generate content that is misleading, fraudulent, defamatory, deceptive, or that infringes third-party intellectual property rights
Use the Service in any manner that is unethical, deceptive, or harmful to other marketplace participants
Transmit any viruses, malware, or harmful code
Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the Service or servers
Use automated systems to access the Service without permission, or scrape, harvest, or mass-collect data beyond normal platform use
Reverse engineer, decompile, or disassemble any part of the Service
Resell, redistribute, or sublicense the Service without authorization
Use the Service to compete with Eto or build a similar service

Etsy Compliance: Eto expects and requires all users to use this platform ethically and in full compliance with Etsy's Terms of Use. We do not condone, encourage, or support any activity that violates Etsy's policies. Any user found to be using Eto in a manner that violates Etsy's Terms of Use may be permanently suspended from the Service without refund.

Eto may suspend or terminate accounts that violate these terms without prior notice if necessary to protect the platform or other users.

10. Third-Party Services and Integrations

The Service integrates with the following third-party platforms and services:

Etsy — marketplace platform (data source and destination for your shop)
Google Gemini API — AI text and image generation (provided by Google LLC)
Anthropic Claude API — AI analysis and research (provided by Anthropic PBC)
Stripe — subscription payment processing (provided by Stripe, Inc.)
Google Analytics — aggregate site traffic analytics (provided by Google LLC)
PostHog — product analytics (provided by PostHog, Inc.)
Google OAuth — authentication (provided by Google LLC)
Resend — transactional email delivery (provided by Resend, Inc.)
WithoutBG — image background removal

By using the Service, you acknowledge that:

You are responsible for complying with the terms of service of all third-party platforms you access through Eto
We are not responsible for the availability, accuracy, or content of third-party services
Changes to third-party services or their APIs may affect the functionality of Eto

The term "Etsy" is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.

11. Intellectual Property

11.1 Our Intellectual Property

The Eto platform, its interface, codebase, branding, and underlying integrations are the intellectual property of ETO and are protected by international copyright, trademark, and other intellectual property laws.

11.2 Your Content

You retain full ownership of your product data, listing content, business data, and any content you upload to the Service. By using the Service, you grant ETO a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing the Service.

11.3 AI-Generated Content

AI-generated outputs (text and images) produced through AI Studio or the Product Hunt Agent belong to you once generated and saved to your account. ETO does not claim ownership of content generated for you. Your use of AI-generated content is subject to the terms of the underlying AI providers.

11.4 Aggregated Data

ETO may use aggregated, anonymized, non-identifiable usage data for platform analytics and product improvement. Individual seller data is never sold or shared for commercial purposes.

12. Data and Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we collect, use, and protect your data.

We collect usage data, analytics, and feature usage events as described in our Privacy Policy to enforce rate limits, improve the Service, and maintain security. We implement security measures to protect your data, including encryption of OAuth tokens, API keys, and credentials at rest and in transit.

13. Disclaimers and Limitations of Liability

13.1 Service Availability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

13.2 AI Output Disclaimer

AI-generated content is produced by third-party AI models and may contain errors, inaccuracies, or unsuitable material. Eto makes no warranty regarding the quality, accuracy, originality, or fitness of any AI-generated content. You are solely responsible for reviewing and approving all AI output before use.

13.3 Business Decisions

The Service provides tools and information to assist with business decisions. However, you are solely responsible for your business decisions and outcomes. We do not guarantee any specific results from using the Service.

13.4 User Responsibility

Everything you do on Eto is your own responsibility. ETO is not responsible for any actions you take using the Service, including but not limited to listing content, pricing decisions, customer interactions, use of AI-generated content, or any consequences arising from your use of data or tools provided by the Service.

13.5 Limitation of Liability

To the maximum extent permitted by law, ETO's total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total subscription fees you paid to ETO in the 12 months preceding the claim.

ETO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, goodwill, or other intangible losses, whether incurred directly or indirectly.

ETO is not responsible for: Etsy API outages, rate limits, or changes to Etsy's API; actions taken by Etsy against your account; data inaccuracies originating from Etsy's API; or outcomes resulting from AI-generated content.

13.6 Data Security

We implement industry-standard security measures as described in our Privacy Policy. In the event of a data breach, ETO will comply with all applicable breach notification requirements under GDPR, Finnish law, and other applicable regulations. While we commit to prompt notification and remediation, no security system is perfect, and we cannot guarantee absolute security.

13.7 Right to Legal Recourse

Notwithstanding the limitations above, if ETO directly and demonstrably mishandles your connected store, products, or account data through negligent or intentional action, and you can provide clear evidence of such mishandling and resulting damages, you retain the right to pursue legal recourse against ETO in accordance with Section 18 (Governing Law and Dispute Resolution) of these Terms.

14. Indemnification

You agree to indemnify, defend, and hold harmless ETO and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights, including the terms of service of Etsy or any other connected platform
Any content you submit, publish, or transmit through the Service, including AI-generated content you choose to use
Your handling of buyer personal data obtained through the Service

15. Termination

15.1 Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account through the Service settings. Upon account deletion, all your data is permanently deleted via a cascading deletion (account data, listings, orders, AI-generated content, agent sessions, OAuth tokens, and all related records).

15.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

Violate these Terms of Service
Engage in fraudulent, abusive, or illegal activity
Use the Service in a manner that could harm us or other users
Violate the terms of service of Etsy or any other connected third-party platform

15.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Your account and all associated data will be deleted. Etsy OAuth tokens are revoked and deleted immediately. No refund is issued for termination caused by your violation of these Terms. ETO may retain anonymized, aggregated data that cannot identify you or your customers.

16. Unofficial Communications and Community Channels

ETO may operate or be associated with community channels, including but not limited to a Discord server. Any such community channels are entirely unofficial and are not part of the Service.

16.1 No Official Status

Nothing discussed, shared, or communicated in unofficial community channels (including Discord) constitutes an official statement, representation, or commitment by ETO
Content in unofficial channels cannot be used as evidence of ETO's policies, practices, or positions in any legal or dispute resolution proceeding
Unofficial channels exist solely for informal community interaction and non-binding updates

16.2 User-Generated Content in Community Channels

Community channels contain user-generated content that is not reviewed, approved, or endorsed by ETO. This includes but is not limited to:

Advice, opinions, strategies, and recommendations shared by community members — ETO does not endorse or take responsibility for any such content, and following it is entirely at your own risk
Language, memes, humor, and other informal content — the tone and language used by community members does not reflect ETO's views, values, or professional standards
Discussions about third-party tools, services, or platforms — any mention of external tools or services does not constitute a recommendation or endorsement by ETO

16.3 Prohibited Discussions and ETO's Position

Community members may occasionally discuss topics such as bypassing marketplace terms of service, using prohibited tools, or engaging in practices that violate Etsy's or other platforms' policies. ETO explicitly states:

Such discussions by community members do not represent ETO's position and are explicitly contrary to ETO's values and policies
ETO actively discourages any discussion of illegal activity, terms of service violations, or unethical practices
ETO cannot monitor all community content in real time and is not responsible for the views, conduct, or actions of individual community members
The presence of such discussions in a community channel does not imply ETO's awareness, approval, or tolerance of those activities
Community members' views, language, and conduct are solely their own responsibility and do not reflect ETO's business practices in any way

16.4 Moderation

ETO reserves the right to moderate community channels at its discretion, including removing content, issuing warnings, and permanently banning users who violate community guidelines or engage in harmful behavior. However, ETO is under no obligation to moderate, and the absence of moderation action does not constitute endorsement of any content.

16.5 Official Communications

Official communications from ETO will be made only through the Service itself, via email from official ETO email addresses (ending in @eto.tools), or through updates to these Terms and our Privacy Policy. Any other communication channel should be considered unofficial.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms on this page and updating the "Last updated" date
Sending an email notification to the address associated with your account for material changes
Providing at least 30 days' notice for material changes that affect your rights or obligations

Your continued use of the Service after such changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription.

18. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Finland.

For users located within the European Union, nothing in these Terms affects your rights under mandatory EU consumer protection regulations, including your right to bring proceedings in the courts of your country of residence.

The European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

19. Miscellaneous

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ETO regarding the Service.

19.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

19.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

19.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
